Verbal understandings and agreements with Sales Representatives shall not be considered binding.
All understandings and agreements must be set forth in writing in a Proposal, Written Contract or incorporated in a Change Order.
ACCEPTANCE: All signed and dated contracts and proposals are subject to review by All American Construction Pro, Inc. Management or All American Construction Pro, Inc. Production Team before work commences.
PRE-EXISTING CONDITIONS: In the event that it is determined by All American Construction Pro, Inc. that this contract cannot be performed as intended, for example, unforeseen structural defects, undiscovered pre-existing conditions to your home or property, All American Construction Pro, Inc. may submit a Change Order to remedy such conditions, if possible. If you decline a Change Order, All American Construction Pro, Inc. may cancel the original contract. If the contract is canceled, you agree to pay All American Construction Pro, Inc. the costs of materials, labor and services provided through the date of cancellation.
SCOPE: Scope of work includes everything explicitly described in the contract as well as any labor and material outside of the scope of work required to bring home up to current code. The homeowner shall be responsible for the materials and installation of any and all items needed to pass inspection.This includes any electrical, plumbing or structural requirements outside the scope detailed in project contract this also refers to smoke and carbon dioxide detectors.
Moving gas lines, upgrading electrical panels, water mains and upgrading or replacing hot water heaters and relocating drains or plumbing on a slab foundation are normal additional costs unless specifically noted in the scope of your written contract.
If architectural designs or project scope renderings are required for permits, an additional fee for those services shall be added to the contract total. This includes blueprints and cad type renderings including 20/20 and chief architect programs displaying elevations, birds eye and wall views. A designer fee of $500-$2,000 may be required to obtain a permit. Requirements can vary between cities and counties.
HAZARDOUS CONDITIONS: All American Construction Pro, Inc. is NOT a hazardous material removal contractor. If at any time All American Construction Pro, Inc. workers come across existing lead, asbestos, mold spores, rodent droppings, termite infestation or other potentially hazardous conditions at the project site, workers shall stop work in the affected area immediately and notify the property owner. Lead safe or asbestos encapsulation will incur an additional fee. We are not qualified to offer health related questions.
MATERIALS REMOVED / DEBRIS: All material removed from structures in the course of renovation/remodeling shall be disposed of by All American Construction Pro, Inc. except those items designated by homeowner in writing prior to commencement of work.
MATERIAL PROVIDED BY HOMEOWNER: All American Construction Pro, Inc. will not be held responsible for any damages due to a faulty or defective item provided by the Homeowner. All American Construction Pro, Inc. cannot be held liable for the functionality of existing gas, plumbing, electrical lines, electrical panels or fixtures.
Painting: Unless noted Painting is not part of work scope. If All American Construction Pro, Inc. is contracted to paint, the homeowner shall select and supply paint. For kitchens and bathrooms we recommend Sherwin Williams “Paint Shield” Anti Mildew, Mold & Microbial.
Drywall Textured Finishes: If included in project scope Shall be Knock-Down, Orange Peal or Trowel Style finishes. Please Note: Smooth, Imperfect-Smooth, Venetian or Distressed Rustic Style Texture is an additional charge.
COLOR: Building materials can vary in tone and shades of color. Materials can appear differently in catalog, print, media screens like iPads & computers and sometimes even samples shown in presentations can vary from the manufacturing process. Natural wood can take stains differently. Granite & natural stones are quarried and each slab can vary in pattern & color.
Baseboard shall be standard 3¾” colonial wood primed baseboard unless specifically noted on contract. Baseboard material allocation not to exceed $1.25 per linear foot.
All Appliances including ovens, fridges, microwaves and ovens shall be provided by the homeowner. As a service, All American Construction Pro, Inc. can install appliances for an additional $95 per appliance unless included on contract. Note: If Appliances are delivered to your home, we invite you to have them Installed in your existing kitchen before the remodel so that you can test run each appliance to verify that the whole assembly and all parts are accounted for, including the install kit. All American Construction Pro, Inc. shall simply uninstall existing appliances and reinstall new or existing appliances at time of remodel. The exception would be a hood range, stove or other appliance that is larger than the existing one and will not fit until we remodel. Option B is to have all appliances delivered and stored in your garage with the exception of your fridge. Because Fridges are large and heavy and often need to be tilted to move into a kitchen it’s best to have the fridge delivered and placed inside your home near the kitchen if that is an option.
Accessories such as towel racks, toilet paper holders and medicine cabinets are normally supplied by the homeowner and All American Construction Pro, Inc. shall install them at the time of remodel. Recessed medicine cabinets shall be installed for an additional $95 unless included in Contract.
Mirrors and Light Sconces shall be provided by the homeowner unless otherwise noted on contract, if noted on contract both items are priced on our grid to reflect a maximum allocation of $100 for each mirror or light sconce.
Shower Doors: Pivot Doors shall be framed unless noted. Sliding shower doors shall be semi-frameless unless noted.
Replacement of existing electrical outlet & Switch covers allocation shall be $2.00 each face-plate.
Knobs and hand pulls for installed cabinetry shall be purchased by the homeowner and All American Construction Pro, Inc. installation team shall install them as a free service at the time of project build.
Any modification of load-bearing walls shall incur an additional fee unless specifically noted in contract scope. Fees may include original building blueprints, building plans,special engineering including wood or steel headers and compliance wet stamp/ seal. Price can vary on an exposed beam vs a non-exposed beam.
In regards to kitchen projects, the homeowner shall purchase and provide all appliances, oven/ cook-top range, fridge, wine/beverage fridge, dishwasher, oven hood vent, microwave, sink faucet, sink and faucet for wet bar, pendant lights, paint, garbage disposal, knobs & pulls for cabinetry.
In regards to bathroom projects, the homeowner shall purchase and provide mirrors, light sconces, sink faucets, medicine cabinet, paint, tile for shower floor, tile for mosaic or accent band for a tub or shower surround, all accessories including t.p. holder, towel rack, hand towel holder, and shower curtain.
